Case Study · Mediation & Consent Order

The situation

A couple in their mid-forties with two school-aged children and jointly held property were separating after a long marriage. The key issues were division of the matrimonial home, care and access arrangements, and maintenance for the children. Both parties were willing to negotiate but had reached an impasse in direct communication.

Our role

We assisted the client through court-annexed mediation at Bahagian Sokongan Keluarga, preparing them thoroughly before each of the three sessions. We advised on the legal range of likely outcomes on each issue so the client could assess proposals against a realistic standard rather than a hoped-for one. Terms were drafted by us once a framework was agreed.

Outcome

A consent order was lodged covering a structured property transfer arrangement, a joint care model for the children with defined access periods, and a maintenance schedule. The entire process, from first consultation to consent order, took approximately seven months. The client noted that the children's adjustment had been less difficult than anticipated.

Case Study · Contested High Court Proceedings

The situation

A client with a significant stake in jointly held business assets and a strongly contested care arrangement for one child. The other party was represented and had taken an adversarial approach from the outset. Direct negotiation had broken down, and a petition had already been filed by the other side when the client came to us.

Our role

We filed a response and counter-petition, managing interim applications in the early stages, including an application relating to access arrangements pending trial. We prepared extensive affidavit material on the business asset valuation and conducted discovery. The client was prepared before each hearing through dedicated sessions with lead counsel.

Outcome

The matter settled at a late stage through negotiation between practitioners, which is not uncommon once the parameters of likely trial outcomes are well understood by both sides. The client achieved a care arrangement and an asset division that reflected the strength of their position as assessed from the outset.

Case Study · Private Consultation Leading to Negotiated Settlement

The situation

An individual who had been considering separation for over a year but had taken no formal steps. They came to the consultation carrying considerable uncertainty about what the legal process would involve, what they were entitled to, and whether their situation even warranted formal proceedings.

Our role

The consultation clarified the client's position under Malaysian civil law and outlined three realistic pathways. Three months later, the client returned to engage us for practitioner-to-practitioner negotiation. No mediation or court involvement was ultimately required. We drafted the terms of a private agreement that was subsequently made a consent order.

Outcome

The matter was concluded with a consent order within five months of the client's second engagement, at the consultation service fee followed by the mediation and negotiated settlement fee. The client noted that the year of uncertainty before the consultation had been more difficult than the process itself.
